In the Republic of Serbia, the Law on Games of Chance (“Official Gazette of the RS”, No. 88/2011, 93/2012-other law) is in force, and on April 28, 2018, the Law on Amendments was passed. The Law on Amendments to the Law on Games of Chance was passed due to the obligation to harmonize the legal regulations with international standards for the prevention and detection of money laundering and terrorist financing. These laws regulate the types of games of chance, the rights and obligations of their organizers, and the conditions and supervision of organizing and generating income in this way.
Games of chance, by definition in law, are those games in which participants can make a monetary gain for a fee, as well as gain in goods, rights, and services, and the gain depends on the case and the uncertain event. Article 3 of this Law determines the transitional period left to legal entities to harmonize their operations with more provisions, and that period is 6 months from the day the law enters into force. As stated in the explanation of the Draft Law on Amendments to the Law on Games of Chance, this law should fulfill the obligation of Serbia to show progress in protecting the financial system from all abuses, as well as to apply international standards in the fight against money laundering and terrorist financing.
It should also be noted that the Bill on the Prohibition of Games of Chance also came into the parliamentary procedure. The proposers are MPs Muamer Zukorlić and Jahja Fehratović. The idea of the Proposal is to close all bookmakers and gambling houses, as well as other types of organizing games of chance. That means banning card games, dice, balls, scratch-scratch, lotto and bingo, and slot machine games. Sports betting, as well as games via the Internet, telephone, radio, and television, would also be banned. And that would mean the end of the State Lottery.
According to the deputies, the reason for this proposal is the protection of citizens, especially minors, protection of family and society, reduction of the rate of criminal acts, as well as prevention of addiction that this type of game causes, while banning games of chance is an act of social responsibility. They are of the opinion that the law should be passed by urgent procedure, “in order to prevent deviances that threaten to destroy society”.
Penalties for violating the regulations of the said law would be fines ranging from 5 million dinars to 30 million dinars. Proponents hope that the proposal will get the required majority to vote, while in case the bill is not adopted, the backup plan is to introduce a law under which there would be a kind of quarantine for gambling, so just like in Russia and the United States gambling was allowed only in special zones in the country. It only remains to wait for the decision to be made by the National Assembly but that seems highly unlikely since the country is generating large amounts of money from the gambling tax and bookmakers are as busy as ever in Serbia.
